The penalty for kidnapping

New Jersey residents may not often think about the consequences of kidnapping. However, this is usually a serious offense that carries a stiff penalty.

FindLaw says that if people kidnap another person, then they have abducted that person or moved him or her to a different place without consent. People may not realize, though, that kidnapping can be both a state and federal offense. Most of the time, someone who kidnaps another person is charged by the state. If someone moves people across state lines, though, then he or she can be charged with a federal offense. Kidnapping can take many forms. A parent might kidnap a child if he or she does not have custody. Additionally, a person might abduct someone if he or she wants to extort people close to the victim.

If people kidnap someone in New Jersey, they face stiff consequences. According to FindLaw, people are typically charged with first-degree kidnapping. The penalty usually depends on the age of the person who was kidnapped, as well as other aspects of the incident. A person who sells the victim or commits sexual assault may be imprisoned for at least 25 years. He or she also may not be eligible for parole. A person who kidnaps someone younger than 16 faces the same length of imprisonment. If a person kidnaps someone over the age of 16, he or she usually might spend between 15 and 30 years in prison.

Sometimes someone might be charged with second-degree kidnapping. This usually happens if people free the person who has been kidnapped. In this situation, a person might be in prison for 5 to 10 years.
