Sexual violence in New Jersey

When you hear or read about a person being accused of a crime in New Jersey, it is all to easy to be misled by the reports as often they seem to leave open little possibility that a defendant might not actually be guilty. Many details are omitted in public reports of arrests for various offenses. Criminal charges involving sexual conduct is one such type of offense. It is important for people who have been accused of a sexually related crime to understand what the law considers illegal.

According to the State of New Jersey Office of the Attorney General, the laws in this state indicate that sexual violence does not necessarily even need to involve physical contact between two people. A person who feels that they are being followed, pursued or otherwise stalked even online may initiate allegations of a sex crime. Other forms of alleged harassment may also lead to charges of sex crimes.

One key element to a sex crime charge is that the person said to be the victim was either unable to consent to certain actions or did not consent to actions that were said to have taken place. A lack of ability to consent may be related to the person's age or mental or physical capacity.

If you would like to learn more about what types of things may be involved in accusations of illegal sexual impropriety in the eyes of the law, please feel free to visit the sexual crime allegations page of our New Jersey criminal defense website.
