Woman charged with DUI

New Jersey residents who are investigated for suspected drunk driving may have to undergo many different tests before they are arrested, if that is the outcome of their investigation. These tests include both field sobriety tests and potentially chemical tests. Details of the results may be used by prosecutors to support certain consequences but they may also be used by defense teams if any of the tests were not accurate or performed properly, for example.

One woman from Newark may be wanting to learn more about the processes followed on the night that she was charged with drunk driving and arrested near the Holland Tunnel. While a chemcial test indicated that her blood alcohol content was 0.21 percent, the specific details of her field tests are not known. Reports simply indicate that a field sobriety test was administered.

What is not known is which test or tests did officers request the woman to take as there are three such standardized field tests that may be used. Often all three tests are administered but a media report referenced only one test. Multiple factors in the performance of these tests may contribute to a person's alleged failing of the test and it is not known what the defendant's actual test results showed.

Working with an attorney may allow New Jersey drivers accused of driving under the influence an opportunity to better understand their arrest test process and results to make informed defense decisions.
