Narcotics and anxiety drugs part of criminal charge

New Jersey leads the nation in strictly monitoring prescription drug orders including imposing maximum durations for some first-time prescriptions for narcotic drugs. This is an effort on the part of the government to curb what it says is the fraudulent issuing of too many prescriptions for potential financial gain. In the last year, over 30 doctors have been targets of criminal action for allegedly prescribing narcotics when not appropriate.

In a recent case, a 53-year-old internal medicine doctor has been arrested for his supposed role in an alleged prescription drug ring. Currently he is charged with a second degree charge for distribution of narcotics. This charge carries with it a potential fine up to $150,000 and a prison sentence between five and 10 years. If his charges were reduced to the third degree, the penalties could be up to $15,000 and between three and five years in prison.

Prosecutors say that the doctor wrote more than 400 prescriptions for oxycodone tablets in 30 mg form between January and early December of 2016. Other prescriptions said to be fraudulently written by the doctor were for Xanax, a drug commonly prescribed to help people with anxiety. A total of 16 other people were arrested, some of whom are said to have taken the prescriptions and resold the drugs for cash.

When faced with serious criminal charges, medical professionals might want to talk with an experienced criminal defense attorney to understand how best to proceed in protecting their reputations and their futures.
