Understanding the Pretrial Intervention Program in New Jersey

If you have been arrested for a criminal offense in New Jersey, you understandably want to know what is going to happen to you. Will you be ordered to spend time in jail? Will you have to pay high fines? Will you have to perform community service? There are many different scenarios depending upon the nature of the charges against you and whether or not you are ultimately convicted of those charges.

The New Jersey Courts explains that there is a program in the state via which you may ultimately be able to avoid formally being prosecuted or convicted altogether. This may be possible via what the state calls the Pretrial Intervention Program. With this program, the state targets people charged with non-violent offenses who also have not had any previous convictions or who have not previously participated in the Pretrial Intervention Program. It may offer you the chance to avoid jail time and a conviction if you successfully complete the program.

In exchange for a suspended sentence, you agree to abide by certain rules and stipulations as laid out by the court. These may include completing mental health or substance abuse treatment, living in a community situation and complying with ongoing monitoring of your activities or status. The judge and prosecuting attorney in your case must both agree to the terms of the diversionary agreement. The agreement is managed by the Criminal Division Management department.
