What is auto-brewery syndrome?

If you are ever arrested on suspicion of drunk driving in New Jersey, you will understand the frightening situation that this can be. Knowing that you may face expensive financial penalties, time in jail and more if convicted can be challenging. To make matters worse, if you know that you are innocent, you may really be unsure of where to turn.

One woman in upstate New York was grateful to have had an advocate on her side after being arrested with a blood alcohol content that for many people would have been fatal. Even with such a high level of alcohol in her system, the woman did not act or seem impaired at all. In fact, after being taken to the hospital because of her high BAC level, the hospital wanted to send her home because she was not intoxicated. CNN describes how the defendant’s attorney pushed for more tests to be completed in order to get to the bottom of the case.

Eventually, tests showed that the defendant was in fact not drunk at all. Instead, she was afflicted with a condition referred to as auto-brewery syndrome. This is a medical condition that is very rare. For people with this condition, their bodies metabolize starch-heavy foods or drinks as ethanol. This metabolism can result in a person having a startling high BAC level even without having consumed any alcohol.

This information is not intended to provide legal advice but general information about a specific medical condition that may result in an inaccurate DUI arrest in New Jersey.
