Examining Schedule II substance administration guidelines

Many of those in Ocean County with whom we’ve worked with here at The Law Offices of Michael T. Nolan, Jr. have come under scrutiny for the administration of prescription drugs. As a healthcare practitioner, your use of medications, particularly Schedule II controlled substances, in the treatment of your patients may come into question. Schedule II substances include common medical narcotics such as morphine, codeine, fentanyl, and oxycodone or hydrocodone. When prescribing these drugs to your patients, you are often placed in the difficult position of trying to balance their need for pharmaceutical relief with the potential for misuse.

The New Jersey Administrative Code outlines the prescribing, dispensing, and administering guidelines for all Schedule II medications. It states that you are not allowed to prescribe more than the greater of either a 30-day supply of these substances or an amount greater than 120 doses. The only exceptions to this law are in the following cases:

  •          Cancer treatment
  •          Terminal illness cases
  •          Patients with intractable pain

Even in these scenarios, you are required to document in the patient’s medical record the objective of the drug treatment, how success will be measured from the treatment, and any further clinical interventions the patient may require.

The NJAC further goes on to state that you must be mindful of the potential for misuse and addiction. However, while it gives recommendations on how to prevent abuse, the decisions regarding your patients’ drug treatments are ultimately left up to you. If, in your professional opinion, a patient requires a strong dosage in order to achieve the treatment aims you are hoping for, you may argue for that belief.
