DUI guidelines for truck drivers in New Jersey

Most in Ocean County may believe that avoiding a DUI charge is relatively easy as long as they do not place themselves in a position where they would need to drive after drinking. Yet would avoiding such a scenario be as easy if driving was a major part of one’s job? According to the Bureau of Labor Statistics, there are over 1.7 million people employed as commercial vehicle drivers in America. These drivers are held to different standards while on the road. The same holds true when it comes to the guidelines regarding drunk driving.

Semi-trucks, tractor trailers, and other large commercial vehicles present a number of unique challenges to their drivers all on their own. Throw into that mix the possibility of drivers being impaired, and one can quickly see how dangerous a potentially drunk trucker can be. It is no doubt because of this that the state has a different blood-alcohol content limit for truckers. That limit is .04 percent, as opposed to the .08 percent limit for drivers of traditional vehicles.

A first DUI offense for a truck driver in New Jersey will result in his or her CDL being suspended for a period of anywhere between 1-3 years. That suspension is placed at 3 years automatically if the driver incurred the DUI while transporting hazardous materials. Any subsequent DUI convictions would result in the complete loss of his or her CDL altogether.

Because New Jersey follows the philosophy of “implied consent,” a truck driver is required to submit to a chemical breath test if asked to do so by law enforcement. If he or she refuses, that could result in an immediate arrest, a loss of his or her CDL for 6 months or up to two years, and/or fines ranging from $250-$500.
