Taking a closer look at ephedrine

Here at the Law Offices of Michael T. Nolan, Jr., we’ve dealt with Ocean County cases involving drugs of all kinds. One substance that you might be surprised to hear that the state of New Jersey classifies as a drug is ephedrine. While you might not be familiar with exactly what ephedrine is or what it’s used for, it may shock you to know how easily you could come across it, and how you could face legal penalties if you use it.

Ephedrine has been used in the Far East for millennia as a treatment for respiratory conditions. It was not until recently, however, that its effect as a central nervous system stimulant was recognized by the supplement industry. Because it promotes a higher basal metabolic rate, it causes the body to burn calories faster. Thus, athletes and body builders use it to help burn fat while retaining muscle.

However, investigations by the Food and Drug Administration have shown ephedrine to contribute to serious health concerns. Federal regulations have since banned the sale of it. However, the guidelines overseeing the reporting of active ingredients by the supplement industry are very weak. This has allowed many widely-known products to still be sold with concentrations of ephedrine.  The workout supplement you currently take could possibly contain it.

New Jersey does have laws aimed at regulating the possession or use of ephedrine. These state that you are not allowed to possess either more than nine grams or three packages of substances known to contain ephedrine as an active ingredient. If you are found to have more than that, you could face a misdemeanor charge. The law does recognize, however, that you may be prescribed medications containing ephedrine by your doctor.
