Who qualifies for New Jersey's conditional discharge program?

The use of illicit substances and illegal drugs is a problem that's not unique major metropolitan areas; such issues could easily pop up in communities such just like Ocean City. The battle against drug abuse is one that those who struggle with may have to face for the remainder of their lives. Overcoming such an addiction can be extremely difficult; one can imagine how much more difficult it would be if those fighting it also had to face the possibility of criminal penalties as a result of their addiction. According to the site, over 1.5 million Americans faced such drug penalties in 2013.

Fortunately, New Jersey lawmakers have allowed those who qualify to not only avoid incarceration after a drug arrest, but also to have the charges against them discharged altogether. Referred to as a conditional discharge, this drug diversionary program is a one-time benefit extended to certain drug offenders. If their application for participation in this program is granted, their legal proceedings are suspended for a period of up to two years. During that time, they're placed on probation and required to undergo random drug testing. If they're able to remain drug free as well as free from other troubles during this probationary period, the charges against them will be dismissed.

In order to qualify for this program, one must meet the following criteria:

  •          No previous drug arrests
  •          No prior participation in any other sort of diversionary program
  •          A determination being made by the court that it’s in the best interests of the community to allow the accused entrance into the program

All application and enrollment fees are the responsibility of the defendant or those acting as his or her agent or guardian.
