The costs of traffic violations in New Jersey

When a driver receives a ticket in New Jersey, the amount of the fine and associated costs will vary according to the alleged violation. Court costs and fine amounts are the same throughout the state for each different violation type. People can find the amount of the fine for their charged violation printed on their ticket. If the officer failed to print it, the person can call their local court for information regarding the amount.

People may pay their surcharges online, by mail, over the phone or at their area MVC Regional Service Center. If the offense is a DUI, the surcharge amount will depend on how many DUI offenses the person has had and what their BAC was at the time of their offense. First-time DUI offenders with a BAC between .08 and .10 percent can expect to pay a yearly surcharge of $1,000 for three years. They will also be assessed a fine of between $250 and $400, an IDRC fee of $230, a fee for the drunk driving fund of $100, a neighborhood fee of $75 and a $100 AERF fee.

Second DUI offenses also bear a yearly surcharge of $1,000 for three years, but the offenders may expect to pay a fine of between $500 and $1,000 and an IDRC fee of $280 in addition to the other fees. Third-time DUI offenders will be responsible for all of the fines and surcharges, but their surcharge will be $1,500 for three years and their fines will be $1,000.

People who are charged with traffic violations may want to get help from a criminal defense attorney. An attorney may be able to negotiate a plea to a non-moving violation for those charged with violations other than DUI. They may also help defend against the case if the charge is for drunk driving.
