New Jersey man accused of shoplifting, drug possession

On July 7, police received a report of a theft at a Franklin Walmart. When officers arrived at the scene, they obtained details of the incident and reviewed video surveillance. The videos apparently showed a 25-year-old Hamburg resident attempting to return stolen merchandise in exchange for cash.

One of the detectives claimed to have recognized the accused man from the video. Once he found the supposed thief, the detective alleged that he carried hypodermic syringes, a controlled substance and drug paraphernalia. It is further claimed that the accused man took older receipts from Walmart, shoplifted various items listed on the receipts and later returned the items in order to obtain cash. It was not stated where or how the man obtained the receipts that he supposedly used for this purpose, but he is now facing several misdemeanor charges.

The man was transported to the Sussex County jail, and bail was set at $10,000. He will not be allowed to post 10 percent of that amount to obtain pretrial release. His charges include possession of a controlled substance, possession of a controlled dangerous substance, possession of drug paraphernalia, possession of hypodermic needles and use of a controlled dangerous substance. He is also charged with theft by deception and shoplifting.

When a person is accused of committing a crime, a criminal defense lawyer could advocate for reasonable bail. It may also be possible for the lawyer to review the circumstances surrounding any searches that were done to determine if they complied with the Fourth Amendment, and the lawyer could then file a motion to suppress any evidence obtained unlawfully.
