3 detained after house raid in New Jersey

Police in New Jersey have taken three people into custody following a raid on a home in Phillipsburg. The raid was executed by the Warren County Narcotics Task Force, the Warren County Tactical Response Team and the Phillipsburg police at approximately 3:40 p.m. on June 10. The three accused are being charged with various drug crimes, including possession of heroin, possession with intent to deliver heroin and conspiracy to possess heroin.

One of the accused, a 54-year-old man, is said to have a criminal history in New Jersey; sources say that he has been imprisoned on at least four separate occasions since 1989. Both he and his 49-year-old wife were detained at the Warren County jail, and their bail was set to $20,000. The third person who was taken into custody is a 28-year-old man from Pennsylvania. Authorities scheduled him to appear in court in July.

The home that was raided is on the 100 block of McKeen Street. It is reported that a fourth individual was also removed from the home, but she is apparently not facing drug charges at this time. The Warren County prosecutor's office released a statement saying that it is preparing a news release regarding the incident.

Although the police may have been authorized to search the home, warrants are often written with parameters and limitations with respect to any search and seizure that is intended. In a situation like this, an attorney may be able to review the manner in which police received authorization to enter the home and the evidence that was presumably used to justify their entry. If these or other aspects of the investigation are found to have been improperly implemented, it may be possible to have the charges dismissed on procedural grounds.
