Were you really speeding?

If you are like most everyone else in Ocean City, then at some you point, you have likely had to try and come up with a good answer for the question “Do you know what the speed limit is on this road?” Yet there may have been times where you legitimately did not know how to respond due to a lack of familiarity with an area or a failure to have the speed limit clearly posted. In such an instance, you may justified in questioning an alleged violation. Understanding what the expected speed limit is in a certain area may help you in contesting the claim that you were speeding.

New Jersey State Code specifies lawful “prima facie” speed limits based on the area in which you are driving (“prima facie” means generally accepted until stated otherwise). These are:

  •          25 miles per hour when passing a school during opening and closing hours as well as recess
  •          25 miles per hour in a residential or business district
  •          35 miles per hour in a suburban residential or business district
  •          50 miles per hour in all other locations

Furthermore, you are expected to reduce your speed anytime you are approaching an intersection, a curve, a railroad crossing, the crest of a hill, or when any other hazard exits due to weather or roadway conditions or pedestrian traffic. You are also required to slow down when traveling along a narrow or winding roadway.

Authorities may elect to assign prima facie speed limits to certain sections of roadway based upon local demographic factors. However, they are also required to post signs providing notice of these special speed limits.
