Juvenile crimes in New Jersey

In New Jersey, there are special processes and terms used for minors who are accused of breaking the law. The New Jersey Courts defines juvenile delinquency as an act by that, if committed by a person 18 or older, would be a violation of some regulation, statute, ordinance or law. This can include acts classified as disorderly person offenses, petty disorderly person offenses or crimes.

Through Christmas Eve, charges involving offenses against people accounted for almost 28 percent of all juvenile arrests in 2015 statewide according to the State of New Jersey. Probation violations were the subject of nearly 22 percent of juvenile arrests and property offenses were involved in over 18.5 percent of juvenile arrests. Public order, weapons and drugs were found to be part of another 12.4, 10.5 and 8.8 percent of cases, respectively. All counties with the exception of Hunterdon County experienced at least one arrest of a juvenile in 2015.

Minors can be put in jail when arrested depending upon the nature of the circumstances including any previous offenses. Parents or others are not allowed to post bail to release a minor from jail. Only a judge’s order can allow a juvenile out of jail. Parents of juveniles are required to be present at all hearings involving the charges made against their child.

The threshold for finding a juvenile guilty is probable cause. This means prosecutors must only show that the specific act did, in fact, occur and there is enough evidence to make the juvenile’s involvement likely. Courts in New Jersey focus primarily on establishing accountability and future rehabilitation with juvenile cases.
