What are New Jersey’s shoplifting charges?

In New Jersey, if you are arrested on a suspicion of shoplifting, you should be aware of how the state handles these charges and what potential consequences you may face if you are ultimately convicted. The Department of Law and Public Safety within the State of New Jersey’s Division of Criminal Justice explains that New Jersey has adopted a tiered approach to shoplifting offenses.

There are four main classes of shoplifting charges, each with its own set of penalties. Details of each include the following:

  • For offenses in which the value of alleged stolen materials is under $200, you can be charged with a disorderly persons offense. This charge can result in a fine up to $1,000 and jail time as long as six months.
  • For offenses in which the value of materials is more than $200 but less than $500, you can be charged with fourth degree shoplifting. This charge can result in a fine up to $10,000 and jail time as long as 18 months.
  • For offenses in which the value of materials is more than $500 but less than $75,000, you can be charged with third degree shoplifting. This charge can result in a fine up to $15,000 and jail time as long as five years.
  • For offenses in which the value of materials is more than $75,000, you can be charged with second degree shoplifting. This charge can result in a fine up to $100,000 and jail time as long as 10 years.
