Police accuse woman of drug crimes, resisting arrest

A 35-year-old New Jersey woman made her first court appearance recently on charges stemming from an incident said to have occurred in Jersey City. The woman has been charged with possession of drug paraphernalia, possession of heroin, escape and criminal mischief and aggravated assault on a medical service provider. Her bail has been set to $7,500.

According to the complaint filed by police, officers found the woman after responding to reports of a dispute at a residence. Officers alleged that she was belligerent during their initial contact and requested her evaluation by medical personnel, at which time she was searched. Officers allegedly found heroin during their search, for which she has been charged with drug possession. At this time, the police complaint says that she violently resisted efforts to arrest her.

Officers at the scene claim that she had in her possession a glass tube they believe is commonly used to ingest certain narcotics. She also allegedly had paper envelopes in her pocket containing suspected heroin. The woman allegedly attacked an emergency medical technician by kicking him in the face and later attempted to escape police custody while she was handcuffed.

Police searches can sometimes be problematic because of Fourth Amendment protections against unreasonable search and seizure. If a defense attorney can successfully argue that a search of a defendant's person was unreasonable in the circumstances in which it was conducted, it is possible that any evidence that was uncovered will necessarily be made inadmissible. In this case, the circumstances of the woman's detention may be thoroughly reviewed to ensure that police contact with her was appropriate and that established procedures were strictly adhered to. It is possible for some of the charges against her to be dropped if sufficient effort is made to undermine their basis.
